PRIVACY POLICY AND PROTECTION OF PERSONAL DATA
CONTROLLED BY EXELCAR
With reference to the Regulation on the Protection of Personal Data, which is known as the GDPR,
we want to provide the information presented below.
What is the GDPR?
From May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of April
27, 2016, which will introduce new issues in the field of clients' rights, will apply.
This is a general regulation that has been in force since May 25, 2018, introduced by Regulation (EU)
2016/679 of the European Parliament and of the Council of April 27, 2016, EU Regulation containing
provisions on the protection of individuals with regard to processing.

Where do we have your data from?
We received your data:
– directly from you,
– from your employer or colleague,
– from third parties with whom you have concluded a contract, the transfer of data is necessary to
fulfill the contract
In the event that we received personal data from you, you have full control over the data.
In the event that we received data from third parties, we only collect basic address and personal
data.
Our collections – the purpose of personal data processing
Because personal data is a necessary element to perform the contract, we process it to:
– preparation and conclusion of a contract with you,
– performance of the contract,
– to provide payment card services
– to enable contact with you to arrange the details of the rental
To supplement the legal obligation that we are burdened with, your data is processed in order to:
– to comply with a legal obligation (storage of contracts, invoices),
– to prevent crime and that our services are used in an appropriate and lawful manner,
– to protect against claims, including debt recovery, judicial and fine proceedings,
– to comply with the provisions of law, courts, police and other state organs,
Consent to the processing of personal data is voluntary but necessary to conclude the contract and
to respond by the administrator to the sent inquiry for a period not longer than 6 months from the
last contact.
In addition, we process personal data with your voluntary consent in order to:
– sending offers and telephone contact to confirm the reservation,
– promoting our brand in social media,
– saving data in cookies and collecting data from websites.
You can withdraw your consent at any time.
Personal data of Tenants and persons authorized to drive the vehicle:
First and last name, email address, company name, residential address, telephone number, social
security number(only for Polish Citizens), tax identification number, ID card number, passport
number, driving license number, driving license issue country – will be processed on the basis of the
need to perform the contract, which the Lessee is a party and to take action before the conclusion of
the contract (art.6 par.1 lit.b) GDPR to provide electronic services and vehicle rental services, and
providing data is voluntary, but it is necessary to conclude and perform the above agreements with
the Lessor , and the data will be processed for the period necessary for the performance of the
Lessor's obligations arising from contracts concluded with the Tenant, and after this period to the
limitation period for claims arising from these contracts,
Is providing personal data necessary?
Providing personal data by you is voluntary, however, in the case of data necessary to perform the
contract and fulfill legal obligations, failure to provide them will prevent us from preparing or
performing the contract or service.
If you do not provide data for marketing purposes, the consequence may not be able to contact you
in the future.
If required by law, in particular: compliance with court, police and other state authorities' decisions,
for tax and accounting reasons – we may require other necessary data from you.
The Lessor may process the personal data of the Lessee or a person authorized to drive a vehicle in
order to realize his legitimate interests consisting in:
Claiming payment of amounts due under a concluded lease agreement (in particular, this applies to
your name, surname, address of residence, data regarding settlements and payment of amounts due
under the concluded agreement,
Securing the property that has been entrusted by the Lessor, in particular the purpose of location of
the rented vehicle in the event of its loss or theft, verification of compliance with the prohibition to
leave the territory of the country indicated in the contract and regulations.
Examination of the services provided by the Lessor, by Contact by email or telephone with the
Tenant and the data may be used for this purpose during the term of the contract and after its
termination.
The Lessee and the person authorized to drive the vehicle have the right to access the data content
and rectify it, delete or limit processing, as well as the right to object, request to stop processing
and the right to transfer data. The above rights may be exercised by reporting to the Personal Data
Inspector (paragraph 62)
In order to exercise your rights, please contact the Administrator provided in your personal data.
Some of your rights depend on the conditions set out in the Personal Data Protection Regulation,
such as:
– removal is impossible as long as it is necessary for the purposes for which it was collected, you have
unfinished proceedings, we suspect or are certain that you have used our services improperly, it is
necessary for tax and other purposes strictly specified in the GDPR,
– transfer is possible when the legal basis for processing is consent or performance of the contract
and the processing is carried out automatically,
– we can refuse an objection if in justified cases we have a legitimate interest of the administrator
and your interests or fundamental rights and freedoms do not prevail.
You also have the right to lodge a complaint with the supervisory body, which is the President of the
Office for Personal Data Protection in Poland.
Do we share or transfer your personal data?
Your data may be made available to our partners, suppliers, service providers only for the purpose of
performing and implementing our services to the extent necessary to perform a given activity.
We do not transfer your data outside the European Economic Area.
Do we process your data automatically?
Your data can be processed in an automated manner and can be profiled.
Our goal of profiling is to provide you with tailored content offers and marketing.
Automatic processing does not significantly affect your situation, does not cause legal effects, does
not affect automatically made decisions.
Updates to our data protection policies.
The personal data protection policy will always be available on our websites.
In the event of legal changes or changes to our internal regulations, it will be updated on an ongoing
basis, and information about the changes will be placed on the home pages.
